This isn’t THEE one I learned from, just Support replying to one of the many people who asked support via Twitter if they’d get in trouble for downloading it for free.
And support answers in such a nice tone it pisses me off, why can’t I get someone when I call to speak that good of english and sound sweet? -.-[/rant]
Per the Terms of Service (ToS) of XBOX Live, you are liable for the cost of purchase of the item at the time of download/purchase confirmation. Since the product (War Games Map Pass / Crimson Map Pack [I don’t know what it actually said as I have Map Pass]) was displayed and purchased at the price of 0 MS Points, you are only liable for the payment of 0 MS Points.
Microsoft CANNOT retroactively enforce a new price on a previous purchase. I know how all these kids around here are yelling “OMG, Specializations came out early, let’s sue!” but this idea of MS charging someone for this map pack is completely false. The legally cannot. Period. If they did charge your credit card for $10 for this map pack, you really could bring them to small claims court.
Small claims court over an unaccepted, uninitiated $10 charge against MS with them not showing up (they won’t show up for $10) will have them get a default judgement against them and you could make their $10 mistake a $130 mistake or however much local small claims courts costs may be.
tl;dr: MS CANNOT legally charge you $10 for the Map Pass when at no point in time did you, the user, ever accept such a charge. They CAN remove the downloaded maps from your account though as MS has the allowance to remove anything from your XBOX LIVE account per the Terms of Service.

Unless you haven’t entered your specialization code. Then it costs 800msp. We all laughed at a friend of ours that paid 800msp cause he was too lazy to enter the spec code when he got it. I bought a season pass so whatever.
