I was wondering what would happen if I got the game early and played it on xbox live? I got an e-mail from the online store that I am buying it from that they would be shipping the game to me on the 31st of October, and it gets delivered usually two days after it has been shipped.
The real question is, will I get in trouble playing it early online?
Microsoft can tell if a game is legit. You’re in no danger. If you want to be sure, you can call Microsoft, as Dragonslayer suggested, and/or play offline (no point in going online since the multiplayer servers won’t be online).
Hmm not so sure. A pirated copy would get you banned but a legitimate copy? Play this one safe man and hit Microsoft up about it and/or just stay offline till the 6th.
Pro tip: Look at your legitimate Xbox 360 disc for a game. Notice in the outside of the inner ring, on the data side, there is an easy to miss barcode. This is on retail copies of games like Halo 4 but not on your CD-Rs you bought at walmart. Now you know why you won’t get banned for playing it early.

Wait is mightyape au shipping on 31st? would this be the same for nz mightyape, I wanna know because I am picking it up in store on the 6th.

You will be fine. You can’t control when a retailer sends you a copy, and it isn’t your fault for receiving a product early through a retailer. The blame will fall on the retailer, not you.
