Because to the seller, it doesn’t matter who the product goes to. So they don’t have to care, and scalpers don’t do anything illegal either.
They’re acting as a middle hand and are allowed to purchase and sell products.
Consumers make scalpers a reality.
Because people are prepared to fork up double, triple or even quadruple the amount of money of the initial price, scalpers will continue to exist, and this is what we’ll see, items sold out in mere minutes, then sold on ebay. Heck, there have been those on this very forum claiming to purchase from scalpers.
When the seller start caring about the fanbase, or when people stop buying from scalpers, we’ll stop seeing scalpers. Only the former is possible, and that’s a long shot to begin with.
At this point in time, our only option is to attempt pressuring Microsoft making an “on-demand” run, for a week, where customers are guaranteed to get what they order.
Games Workshop did that with the Indomitus Box.
First scalpers bought a significant amount of boxes, then GW made a second run where they first took orders, and then produced for all orders. No limited supply.

The scrappers were quick and brutal on this one.
Maybe do what Good Smile Company is doing (sells nendoroid, chibi style figurines for instance). They open order for everyone within a time period, so everyone that ordered will get it and it notify for microsoft the amount of consoles to produce.
It’s still limited but in time and invalidates the action to scalp (You may find people selling it higher price after the limited time sell but it’s better than what we actually have)
