I opened a used case of Gears of War 2 from Gamestop and found a unused map pack/48 hour code and took it. On the XBL marketplace, it would cost be around $10.

Probably not. You bought that case at Gamestop and thus, anything it contains is yours.

I should have been more clear, I opened the case on the shelf at Gamestop. I did not puchase the game, case, etc…
