yes it is
It is legal to use any modded gametype in Custom Games, as long as it doesn’t give you any boost in multiplayer matchmaking.
In actuality, using modded gametypes (Unless the developer has otherwise directly approved such a thing) is actually against LIVEs Code of Conduct, which you can read here.

I would like to see either a direct statement from Frank O Connor or 343i themselves -or- the Code of Conduct stating that modded gametypes are legit and stating the very thing you said. Otherwise, it is not legal and against Code of Conduct.

The gametype is still downloadable.
It’s like unlocked content, because it’s the only thing Mythic Slayer is doing, you can’t have a Pelican in Forge World but it’s no problem on Spire where a Pelican is used.
The weirdest thing is the Target Locator you can spawn on Anchor 9, it’s the only map where you can play with that weapon.
All shades are available on Forge World (but lack the proper color and the black turning thing is slightly out of the base) , like the Falcon with passenger seat (and the turret under the pilot) .
