All the maps are in every playlist in the game. Everybody in the lobby needs to have them for them to show in online matchmaking. If 1 person doesn’t have the maps, then they don’t show up. DLC in Halo has been like this since Halo 2, the only difference is that Halo 2 and 3 made DLC mandatory for most playlists in order to play them, and Halo Reach and 4 don’t.

You haven’t been scammed at all, since you can play on any of the DLC maps any time you want in custom games or forge. If you couldn’t play them in any game mode then you would be getting ripped off. So technically they haven’t broken any laws since you can still use what you have paid for. If you can quote something that states you are guaranteed to play on the DLC in matchmaking, then by all means do so. But nowhere in the XBL Terms of Service or the map pack descriptions does it actually say you are guaranteed to play on the maps in online multiplayer matchmaking.
