Would you get banned if you modded for blue flames and nothing else?
Yes, you WILL get banned. Microsoft is extremely touchy about modding. Even if it’s a more or less harmless mod like adding Blue Flames, it’s more about the fact that you can mod it and are willing to do so to get what you want. So, yeah; you mod anything on Xbox Live, anything at all, no matter how small and insignificant it may seem, and you will get banned.

You can’t even mod it anyway and anyone who tells you otherwise is an idiot. The blue flames are SERVER related items, not DLC or anything like that.
Basically, if you’re approved to have it you’ve got it and if you’re not then you don’t. My advice to you, unless you want your account banned then don’t do it.
If you had Bungie Mobile back in 2011, they gave it out for free. Yes, if you wanted the blue flames, you needed an iPod or iPhone to get it because Bungie mobile was not for anything else. (To my knowledge.)

It was available through their website for two weeks as well; people with the app simply got access a week, maybe two weeks, earlier than those who used the website.

This is correct, there was a slight delay between the app and website but people eventually got what they asked for.
