Yes, if you knowingly enter or stay in a modded lobby or play with those who are modding, there is a good chance your account can be banned by the system. Best to avoid and report any players who are modding the game

To add to what stckrboy stated, the reason for this is that knowingly playing with people who are modding in the game combined with the fact that 343i as a developer does not allow the use of mods would violate LIVE Code of Conduct.
From the LIVE Code of Conduct page:
Don’t cheat or tamper. For example, don’t:
- Intentionally play with someone who is using unauthorized software or methods343i from what I understand would rather there not be a gray line, so as a developer, no mods in Halo (Like most other Xbox titles) are allowed to be used. Also, keep this in mind, modded lobbies can be ‘infected’ in any number of ways. Basically the lobby can be modded to change stats, armor status, the four player Letter and Number Service tag, nameplates, and other features of your Reach profile without your consent and may very well be infected to intentionally trigger the automated banhammer on players (Changing some of those things I mentioned in this fashion will trigger it 100% of the time by the way).
It’s just best to be safe and leave those games the second you notice any form of modding going on to prevent a permanent ban from Reach or in more rare cases a ban from Xbox LIVE.
