The Kinect functionality for Halo CEA will not be on the disc when you buy it. Instead, the Kinect support will auto-download over Xbox Live when you put the game in your console. The game’s case has no mention of the Kinect features however the instruction manual says “players with a Kinect sensor can take advantage of a a number of Kinect-enabled gesture and voice features, including the ability to select and analyze enemies and objects—unlocking vital intelligence about them in the Library—and to move among in-game menus.”
343 can’t seem to add gimmicks properly without having the functionality on the disk? Sounds a bit…amateurish to me. I don’t have a kinect thankfully but still…you think that sort of information would make on the weekly updates.
It’s not a big deal anyways, most that have a 360 have xbox live (sliver or gold doesn’t matter) but those that don’t and have Kinect need to get live.
According to the sparkcast, kinect features where added as a last minute “let’s see what we can do with this” and didn’t make it onto some of the disks

And not by choice. They were forced by Microsoft to add them to promote Kinect sales.

Small or not, it’s a feature many of the fans are eager to see and many who don’t have a Kinect feel cheated.
To be brutally honest, I am glad that is the case. I would hate to have the Better with Kinect Moniker on the box. The game is too epic to have that on the cover. Small detail and trivial to worry about? Yes, but nonetheless I think it is better without it.
