They will be saved, since they already exist on your Xbox 360 hard-drive.

Like Mahykla said. Yes they will. All the data you played in Halo 4, even all other games you played, will be saved directly to your HD. No matter how many different copies you have, it will remain their.
make sure youre you have a back-up USB, just in case.
Well, with all the trobles that exists, it’s a posibility, in my personal experience, even playing the same copy from the very start of the game, i have to play 2 times the same mision cause it didn’t count on the commendations, and when i finish the campaing on legendary i didn’t get the achivements…so its a bet…

It is very likely that you didn’t complete the campaign while you were connected to the internet. Only then will completion count towards your Commendations.
As for Legendary, you should check that you see the Legendary symbol on all completed missions. If the achievement still hasn’t popped up, that is very strange.
Here’s another concern for the GOTY edition: I am planning on getting a new Xbox 360, and I got all the GOTY stuff on my thumbstick will it transfer over to the new Xbox with no problems or should I worry about the DRM issue?

Hardware isn’t as smart as you think it is. If I put my hard drive into a different xbox, the different xbox will be none the wiser. Just know that if you are going from the old-style Xbox to the new-style, you have to get kind of techie with how you get the old-style hard drive into the new-style case.
Yeah I’ve seen videos of it. It’s way beyond my area of expertise. Hopefully the GOTY content will transfer over with no problems.

Or you could just transfer everything from the old Xbox to a portable hard drive, plug it into the new console, then transfer to the new hard drive. Then do a license transfer. Thats all I did. Took around 20 mins to do, and with little to no hassle.
