They go after the retail company who lost/released the copy(s), with fines, and then next launch, instead of that retail company getting it’s shipment early, they get it a week or so after release.

Well it all depends on if they did it by mistake or intentionally.
I know Argos sent out Halo 3 early back in 2007, Microsoft gave them a slap on the wrist and told them not to do it again.
If it was intentional, expect lawyers to become involved.
They do nothing to the player if they get it from a store. The player got the copy legitimately, so why punish him? It was the store that broke the street date.
