Copyright Complaint Question!

Good afternoon,

My name is Ariel Torano and I am currently creating adverts for my college project at Full Sail University for my degree in Media Communications. I have to generate an advert that represent certain media influence and triggers certain regions of the brain. I was granted permission to use any content I feel passionate about, so I immediately chose Halo 5. I want to create a story montage with 80% in game footage and around 20% campaign video footage to produce a commercial. This advert is for educational purposes only and will have absolutely no monetary gain or personal gain. I want to know if I have permission to use your Halo 5 contents for this purposes and this purpose only. My video in the description will have the Microsoft copyright complaint information and information reflecting that it is indeed a school project and is no way affiliated with Microsoft or 343. The reason I ask is because the copyright information distributed by Microsoft does allow me to use certain footage for personal consumption, but does not allow any form of commercial usage. I am not sure a commercial for educational purposes only falls into this bracket. I deeply respect both Microsoft and 343 and want to make sure that all my actions are copyright compliant.

You could just call it a parody or simple use disclaimers and give them credit for it, it would be like any other gaming video on youtube

You would need to write to 343 directly (or more likely their attorneys) in order to obtain permission, rather than posting in the forum. However, if you aren’t making money off it you should be fine.

If its not for profit I think it doesn’t matter

Pretty sure your purposes would not fall under commercial usage as you don’t stand to materially gain from the usage.

Not an IP lawyer, but I’d feel safe in your position.

I have already contacted just about every outlet possible. When I called Microsoft they told me to try the forum area. I contacted certain emails, Facebook, Twitter, other forums, and called them directly. Thanks for the info!

They are giving you the old run around. Companies are different about their copyrights, i.e. regardless of whether it is for profit or not for profit you may need to get permission for any public display. If this is a class project only to be shown in class it will probably be ok, but you should contact 343 directly.

I think you should be fine since it’s a school project and your not generating any money off of it. Try to see if you can get in contact with 343 directly. They’re pretty cool, so I think they would let you advance without any problems.
