Can We Get An Official Statement As To What Can And Cant Be Sold On Sites Like Red Bubble?

Hello! I am a life long Halo fan and I’ve recently gotten into creating Halo fanart and posting it on Red Bubble. I started with these 2 designs.

They have sold very well and it feels good to create content that represents a brand that I love. But lately any and all Halo related art that I post gets taken down within a couple dats. All original work with no symbols from the game. Examples below. Had to be Imgur because my forums account is too new to post images.

I would love to continue to create Halo fan art and list it on Red Bubble, but it keeps getting automatically flagged as potentially infringing on the IP despite there being hundreds of listings with art that is stolen directly from the game.

If possible it would be great to get in contact with someone at Microsoft that can make it so that I can continue to post my art. Or at the very least a solid “No, you are not allowed to post Halo art on Red Bubble.” I’m not exactly sure why my art keeps being taken down. If I dispute it with Red Bubble they say that they actually got a direct notification from the IP holder to take it down, which I do not believe in the slightest as there is plenty of Halo art on there and the first email I receive says that it was automatically flagged.

Like other companies, Microsoft protects its intellectual property and prevents other parties profiting from its unauthorized sale.

Except as described here, you can’t sell or otherwise earn any compensation from your Item, including through advertisements in the Item. This means you can’t charge money in exchange for your Item, post it on a site that requires subscription or other fees to view the Item, or post it on a page you use to sell other items or services (even if they have nothing to do with Game Content or Microsoft). You also can’t use Game Content in an app that you sell in an app store.

Thanks for the response, but can you explain to me then why there are thousands of Halo related items you can buy on Red Bubble? New ones and ones that have been there for years, continue to be sold constantly, including some are taken directly from the game? I mean look at this…

I doubt you’ll receive a satisfactory answer through an online forum. My best suggestion is to speak with competent legal counsel and/or contact Microsoft’s legal department if you have questions and concerns.

Create your own original artwork. You’ll find it much more satisfying

Thanks anyway. Definitely not willing to drop any money on some kind of legal counsel for this, but maybe I’ll drop it in some sub reddit and see what people have to say. I’ve tried to contact Microsoft, but all I can find is support for products. Thanks again.

Wow, what an annoying response lol. I have created my own original artwork. I just also happen to also make Halo art and wanted to see if I could post it on Red Bubble with the THOUSANDS of other pieces of Halo artwork on Red Bubble that don’t get taken down. Your comment honestly couldn’t have been less helpful. You should try to be a little more self aware of how pretentious you come off as in the future.
