The voice bans in Halo: Reach were well publicised and it was well known that they were triggered by the player frequently being mute by other players. This happened frequently in the MLG playlist because muting at the start and un-muting at the end to say good game (or talk trash as the case may be) is faster for a lot of people than switching between the “Team and Party” and “All Players” options for overall voice control.
As one of the players who frequently does search with the OP, I can confirm that he’s telling the truth. Heck, even on team and party he’s not even the kind of guy who is talking constantly, and I’ve never heard him say anything negative to or about another player in the game.
Just in case it is an audio feedback problem, one solution would be to buy third party headsets through which you would run ALL of your audio (i.e. they would replace your TVs’ speakers entirely). A lot of people enjoy playing with those anyway, since it can make the games feel more immersive.
343 should remove the mute ban feature.

Sounds to me like some group of kids raged and decided to report you because they lost.
My brother and I play right next to each other just as you do but have never had this problem. Try muting each other over xbox live rather than in game… That seems to work for us
I played a lot of Reach and knew about voice bans but not because I received one. Even my wife who didn’t play much Reach at first would ask why players would show up as already being muted. And in case you are wondering, I know I never received a ban in Reach because I did not play on Team and Party only and could hear and speak to other players on my team and the other team if I wanted to. I don’t fault you for assuming that though. I’d probably assume the same thing if I was on the outside looking in.
The suggestion of muting each other through Xbox rather than through the game is a good one and I think we’re going to start doing that from now on and see if it has an effect. From what I’ve seen this is a problem that others are having as well, some who claim to only play in party chat.

Sounds like people are already abusing the mute ban. That’s unfortunate.
But yes, it sounds like the situation in Reach is carrying over to Halo 4. People are consistently muting people, rather than utilizing the XBOX settings to set voice communication to Friends Only. There’s an option there to do that, but rather than taking the easy route, they’d rather unknowningly use the mute feature in game.
i didn’t read the whole thread to see if somebody else already posted this but perhaps you should try muting your own mic from the system preferences rather than muting each other in game. i do this to my kinect mic all the time because of the echo and it’d be pretty silly to ban myself from voice for muting myself. tho with what the quality of what i’ve seen so far from 343 i don’t put it past them…

Yep but players could always unban the offending player if they wanted to hear them

We have a similar gaming set-up. Split-screen is the devil.
Rather than use in-game chat, we get into a party to chat with our friends and then I mute him (he doesn’t mute me). I wonder if because you both muted each other that might have set something off.
How can I get my wife to play Halo with me?!

They weren’t banned for muting someone, they were banned for being muted. If you are constantly being muted by other players, XBL Enforcement assumes you are behaving poorly over voice chat and suspends your chat privileges.

Ive had the exact same problem. I have a similar set up with two tvs in my living room, each to their own xbox and a monitor that doubles as a tv for my third box (all Halo limited editions…). The first night we went to play the two people in the room muted me because they didnt have sound cancelling headphones like I do. We had a fourth over xbox live who jokingly muted me and then unmuted, so I guess while idle in the lobby, three mutes is good enough to get you auto-muted. I never got a notice nor have I seen one of any kind which says “Chat has been banned for unbeknownst amount of time” or anything like that. In fact I thought it was a glitch in Halo 4 so I did a search to try and figure out what was going on and why I, unlike all my friends, couldnt hear anyone.

Ah yes, because someone knows how the voice ban works they OBVIOUSLY WERE VOICE BANNED IN REACH! So does that mean if i know how the laws on murder are in America does that mean i killed someone?

yea i got a ban for playing on 2 xbox’s and 2 tv’s w. the misses, but for using extra controllers so we didnt have to play online w/ strangers, the controllers went idle and we both got banned for a day…
i would love to see an online mode that lets you earn xp that is 1v1
