343i and Product Liability

I did not want to do this, but I’ve gotten to the point now where I’m emotionally distraught and just down right fed up and upset with my inability to play Halo 5 sans campaign.

This thread is addressed to consumers of Halo 5 Guardians who have been having a less than stellar gaming experience with respect to H5:G’s online gaming capability as of recent. I am not attacking 343i as a company, nor do I claim to be a legal expert; I only wish to stick up for our rights as consumers. The question is, “Does this game meet the criteria of product liability?” If so, what can we do to settle the issue at hand, whether it be through mediation with 343i or settlement through the justice system?

Here’s a little primer on product liability:

Product liability refers to a manufacturer or seller being held liable for placing a defective product into the hands of a consumer. Responsibility for a product defect that causes injury lies with all sellers of the product who are in the distribution chain. In general terms, the law requires that a product meet the ordinary expectations of the consumer. When a product has an unexpected defect or danger, the product cannot be said to meet the ordinary expectations of the consumer.

Now with respect to H5:G, I truly believe we have overwhelming evidence of this legal matter existing through the mass posts and mass observations of Halo’s community right in these very forums via these threads:

Do you guys accept this business malpractice that claims to have a working, basic functionality of multiplayer, not to mention forge mode also being broken, as well as the REQ system too (which, by the way, people paid good money for these and do not receive all the benefits they were promised when they enacted in the transaction)? I can pull up those threads too if you’d like. These kinds of problems has been persisting since the ugly release of MCC, ever since 343i decided to start making their own Halo games.

It’s not like this is anything major like violent video games or controversial genres of gaming. All I am asking for is a working game. I know 343i is looking into these problems, but for the love of Halo, it’s 2015; we’ve taken a step back backwards in terms of video game technology.

However, upon reviewing the law again during this write-up, it has come to my attention that 343i may not be liable for a defective product, unless one could argue somehow that actual damages have been sustained by a party (ergo the vein under your eye throbbed so much that it exploded due to uncontrollable rage that resulted from an unbearably unplayable game.

With that said, I included in the poll options of whether or not we have an instance of a breach of contract/failure to perform on 343i’s part.

TL:DR 343i screwed up Halo so badly, that we may be entitled to compensatory damages of some sort, either due to product liability, breach of contract, or by some other means.
